Welcome to Ellery ADU Studio Long Beach. These Terms of Service govern your access to and use of adubuilderlongbeach.com, including any service request you submit through this site or by phone. By using adubuilderlongbeach.com or submitting a service request, you agree to be bound by these terms in full. If you do not agree, please do not use this site.
Important Notice - Arbitration and Class-Action Waiver: These terms include a binding arbitration agreement and a class-action waiver. Those provisions appear in the Dispute Resolution section below. They affect your legal rights in a significant way: they limit your ability to sue in court and require most disputes to be resolved through individual arbitration rather than through a class or jury proceeding. Please read that section carefully before you use this site.

Eligibility to Use This Site
To use adubuilderlongbeach.com or submit a service request, you must:
- Be at least 18 years of age;
- Have the legal capacity to enter into a binding contract under applicable law; and
- Have the legal authority to authorize work at the property address you provide - meaning you own the property or have the documented right to request and approve home-service work there.
By using this site, you represent and warrant that you meet all three of these requirements. If you do not, you are not permitted to use this site or submit a request.
Limitation of Our Liability
adubuilderlongbeach.com and the referral service are provided as is and as available. Ellery ADU Studio Long Beach makes no warranty - express, implied or statutory - that a service business will be available, will contact you, will show up, or will produce any particular result for you.
To the fullest extent permitted by applicable law, Ellery ADU Studio Long Beach, its owners, officers, employees and affiliates will not be liable to you for any indirect, incidental, special, consequential, exemplary or punitive damages - including lost profits, loss of data, or damage to property - arising out of or relating to your use of adubuilderlongbeach.com or the referral service, even if we have been advised of the possibility of such damages.
In any event, Ellery ADU Studio Long Beach’s total cumulative liability to you for any and all claims arising out of or relating to this site or the referral service will not exceed one hundred dollars ($100.00) or the amount you actually paid to Ellery ADU Studio Long Beach in connection with the specific request at issue, whichever is greater - recognizing that in most cases you have paid Ellery ADU Studio Long Beach nothing, making the effective cap one hundred dollars.
This cap applies only to Ellery ADU Studio Long Beach’s own conduct. Responsibility for the quality, safety, timeliness and outcome of any work performed at your property rests entirely with the independent business that performed it. Nothing in this section limits or affects any claim you may have directly against that business for its own acts or omissions.

AfterYour Indemnification Obligations
You agree to indemnify, defend and hold harmless Ellery ADU Studio Long Beach, its owners, officers, employees and affiliates, and each of the independent businesses in its referral network, from and against any and all claims, demands, actions, damages, losses, liabilities, costs and reasonable attorneys’ fees arising out of or related to:
- Your use of adubuilderlongbeach.com, including any action you take or fail to take on the site;
- Any information or content you submit through the site or by phone - including the accuracy of that information, your authority over the property listed, and your right to provide the phone number you supplied;
- Any breach by you of these terms or of any applicable law or regulation;
- Any dealings, transactions or disputes between you and any business to which you are referred; and
- Any property damage, personal injury or other harm that arises from or in connection with any work performed at your property as a result of a request you submitted.
This indemnification obligation survives the termination or expiration of your use of adubuilderlongbeach.com and these terms. Ellery ADU Studio Long Beach reserves the right to assume exclusive control of any defense of a matter subject to indemnification by you, at your expense, and you agree to cooperate fully with that defense.
Governing Law and Venue
These terms are governed by and construed in accordance with the laws of the State of CA, without giving effect to any conflict-of-law rules or provisions that would require the application of the law of a different jurisdiction.
To the extent that a court proceeding is permitted under these terms (including the Dispute Resolution section), that proceeding must be brought exclusively in the state or federal courts located in CA, and you and Ellery ADU Studio Long Beach each consent to personal jurisdiction in those courts.
How the Ellery ADU Studio Long Beach Referral Service Works
Ellery ADU Studio Long Beach operates adubuilderlongbeach.com as a marketing and referral service for home services in Long Beach, CA and surrounding areas. We advertise home services, accept service requests through this website and by phone, and pass those requests to local service partners and the independent companies that fulfill them.
Every estimate, repair, installation and service call requested through this site is performed by one of those independent businesses - not by Ellery ADU Studio Long Beach. We do not perform home-service work of any kind. We do not employ or engage the tradespeople, technicians or crews who perform the work, and we do not direct, supervise or control how they do it.
Scheduling, pricing, the scope of each job and the materials used are determined entirely by the independent business that accepts a request. Availability of any business for your specific job is not guaranteed. Ellery ADU Studio Long Beach’s role begins and ends with marketing and referral.
Severability
If any provision of these terms is found to be invalid, unlawful or unenforceable by a court or arbitrator of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
There is one exception to standard severability: the class-action and collective-action waiver in the Dispute Resolution section is not severable from the arbitration agreement. If that waiver is found unenforceable with respect to a particular claim, the arbitration agreement will not apply to that claim, and that claim must be resolved in court.
Changes to These Terms
We may revise these terms at any time. When we do, we will update the Last Updated date shown at the top of this page. We will not provide individual notice of changes.
Your continued use of adubuilderlongbeach.com after a revised version is posted constitutes your acceptance of the updated terms. If you do not agree to a change, stop using the site before the updated terms take effect.
Dispute Resolution
(a) Informal Resolution First. Before starting any formal legal proceeding against Ellery ADU Studio Long Beach, you agree to contact us through https://adubuilderlongbeach.com/contact-us/ and give us a reasonable opportunity - at least 30 days - to resolve the problem informally. Most concerns can be addressed this way.
(b) Binding Individual Arbitration. If a dispute is not resolved informally, it will be settled by binding arbitration rather than in court. Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, which are available at www.adr.org. By agreeing to arbitration, both you and Ellery ADU Studio Long Beach give up the right to sue each other in court (except as noted below) and the right to have claims decided by a judge or jury.
(c) Class Action Waiver. All claims must be brought in an individual capacity only. You and Ellery ADU Studio Long Beach each waive any right to bring or participate in a class action, collective action, consolidated action, or any class-wide or representative arbitration proceeding. The arbitrator has no authority to consolidate more than one person’s claims or to preside over any form of class or representative proceeding. This waiver is a material term of this agreement; see the Severability section for what happens if it is unenforceable.
(d) Jury Waiver. To the extent any matter is litigated in court as permitted under these terms, both you and Ellery ADU Studio Long Beach waive any right to a trial by jury.
(e) 30-Day Opt-Out. You may opt out of this arbitration agreement by sending written notice to us through https://adubuilderlongbeach.com/contact-us/ within 30 days of the date you first accepted these terms. Your opt-out notice must state clearly that you are opting out of the arbitration agreement. Opting out will not affect any other provision of these terms.
(f) Small Claims and Injunctive Relief. Either party may bring an individual claim in small claims court, provided the claim qualifies under that court’s jurisdictional rules. Either party may also seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent misuse of this site or infringement of intellectual property rights, without first going through arbitration.
Independent Businesses - No Liability of Ellery ADU Studio Long Beach for Their Work
The businesses that perform work as a result of requests submitted through adubuilderlongbeach.com are independent contractors. They are not employees, agents, legal partners, representatives or joint venturers of Ellery ADU Studio Long Beach, and Ellery ADU Studio Long Beach does not control, supervise or direct their work in any way.
Ellery ADU Studio Long Beach is not responsible or liable for:
- The quality, safety or timeliness of any work those businesses perform;
- Their pricing or billing practices;
- Their licensing, bonding or insurance status;
- The conduct or competence of their employees or subcontractors; or
- Any act, omission, negligence, property damage, personal injury or other loss caused by them.
The contract for any work performed at your property is formed directly between you and the business that performs it. Ellery ADU Studio Long Beach is not a party to that contract and has no obligations under it.
A referral through adubuilderlongbeach.com is not an endorsement, certification or guarantee of any kind. Before authorizing work, you should independently confirm that the business holds the licenses and insurance required in your area and that you have reviewed and understood their written contract or proposal.
Any dispute about the work itself - its quality, cost, completion or any resulting damage - is a matter between you and that business.
No Warranty on Work Performed - Coordination Assistance Only
Because Ellery ADU Studio Long Beach does not perform home-service work of any kind, we give no warranty or guarantee - express or implied - on workmanship, parts or materials used in any job. Any warranty on the work itself is the sole responsibility of the independent business that performed it, and any warranty on parts or materials is provided by the manufacturer on the manufacturer’s own terms. Before work begins, ask the performing business for its warranty terms in writing.
If you are not satisfied with work performed as a result of a referral through adubuilderlongbeach.com, Ellery ADU Studio Long Beach will, as a courtesy, act as a go-between: we will attempt to coordinate a return visit by the original business to address your concern, or we will introduce you to another provider. This is a courtesy coordination effort only - it is not a guarantee of any particular outcome, and it creates no obligation on Ellery ADU Studio Long Beach to ensure the concern is resolved.
Ellery ADU Studio Long Beach will never perform, redo or repair any work itself. We are a referral service, not a service provider. Do not rely on Ellery ADU Studio Long Beach to correct or pay for the correction of work you are dissatisfied with - any remedy for deficient work must be pursued directly with the business that performed it.
